Decision On Extradition Of Journalist Delayed
A decision by the Supreme Court over whether to extradite former journalist Ian Bailey over the murder of Sophie Toscan du Plantier in Cork in 1996 has been reserved.
Ian Bailey's lawyers said the State's case in favour of his extradition to France is "untenable", while the court reserved its decision on whether to allow the 54-year-old be questioned by French authorities over the murder.
Lawyers for the State acknowledged that no decision had been taken by the French authorities to try Ian Bailey, although senior counsel Robert Barron received further instructions and returned to court to say the Justice Minister Alan Shatter held the view the European Arrest Warrant is for the purposes of prosecution.
The Supreme Court has reserved judgment on three legal points raised by Bailey's lawyers in the course of this appeal.
If they find against the former journalist, the case will re-open to hear new evidence, including documents from the DPP's office criticising the Garda investigation into Sophie Toscan du Plantier's death.
