Ryanair Loses Latest Legal Battle Over Icelandic Volcano
Budget airline Ryanair has lost the latest round in its legal battle to avoid paying for hotels, meals and drinks for passengers disrupted by delayed flights during the Icelandic volcano eruption in 2010.
EU legislation oblige airlines to provide passenger care, but not compensation, when flights are cancelled by “extraordinary circumstances” beyond their control.
However Ryanair tried to argue that the closure of airspace after the eruption of the Eyjafjallajokull volcano was so extraordinary that the rules should not apply.
An advocate general of the European Court of Justice in Luxembourg declared today: “In everyday language, the term ‘extraordinary circumstances’ refers to all circumstances over which the air carrier has no control: an event which is not inherent in the normal exercise of the activity of the air carrier concerned and is beyond the actual control of that carrier on account of its nature or origin.
“In the view of the Advocate General, all events which meet that description are bracketed together under a single notion, leaving no room for a separate category of ‘particularly extraordinary’ events which would fully release the air carrier from its obligations.”
The “opinion” will now be considered by the full court, which will deliver a final verdict later this year. Around 80 per cent of cases follow the view of the Advocate General.

Local Air Traffic Control Applauded
The successfully-run British Isles-wide system of airspace control was this week held up as an example of best practice in dealing with air navigation. Ireland's Minister for Transport, Noel Dempsey has called on Europe to look at how the UK and Ireland cooperate in air navigation, after the disruption caused by the volcanic ash plume.

Electric An Post Mail Scooters Sold Off For Fraction Of Cost Price
Eight electric scooters bought by An Post, allegedly costing €10,000 each, have been sold on for a fraction of the price after plans to use them for delivering mail had to be scrapped. The eight Italian-made Cargo Scooters were used during trials around the city centre, but it was discovered they were not suitable for delivering mail.

EC Opens Investigation Into Aer Lingus Takeover
The European Commission (EC) has opened an in-depth investigation (phase II) under the EU Merger Regulation into the proposed acquisition of Aer Lingus by the low cost carrier Ryanair, which was notified to the Commission on 24 July 2012. Both are major players in the Irish passenger air transport services market.

Longford Road Death Probed
Gardaí at Longford town are investigating a single vehicle fatal road traffic collision which occurred at Bornacoola, Carrick On Shannon, Co Leitrim at approximately 8.21am this morning. A 36-year-old man - who was the only occupant of the 4 X 4 vehicle - was fatally injured as a result of this collision.
