Lawyer Cleared Of Assault On Colleague
A well-known criminal solicitor has been cleared of assaulting a colleague outside a courthouse.
49-year-old John Devane, of Quinlan Street, Limerick, was charged with assaulting John Herbert outside Limerick District Court on May 25, 2011.
But Judge Denis McLoughlin found him not guilty yesterday following a lengthy trial in which Mr Devane accused Mr Herbert of poaching his client.
The judge said that in any criminal case the standard of proof has to be beyond all reasonable doubt, adding that there was a number of "inconsistencies" in the State's case.
Limerick District Court yesterday heard that the case arose after a client of Mr Devane's, Philip Ambrose, asked Mr Herbert to represent him.
