Aer Lingus Sue The State For €61m

Aer Lingue have launched legal action against the State over the 2008 air travel tax.

The air travel tax was introduced as part of the Finance act in 2008, however it was ruled to be in breach of EU regulations in 2010.

The act introduced a €2 tax for every passenger departing on flights from an airport within 300km of Dublin Airport and a €10 per passenger tax on passengers departing on any other flights.

Aer Lingus had been paying the tax since 2009 when it launched until March 2011 when it was repealed following a complaint that it breach EU regulations.

The airline is now suing the State for €61 million and had sought to have the case fast-tracked to the Commercial Court.

However the judge refused the fast-track application and the case will now proceed via the normal High Court procedures.
