No Further Charges In Mr C Sex Assault Case

Sexual assault charges against a man whose successful Supreme Court challenge led to the unlawful carnal knowledge legislation being declared unconstitutional, have been dropped.

On Tuesday, the prosecution told Judge Patricia Ryan that the State wished to enter a nolle prosequi - meaning "unwilling to pursue" - in relation to the charges against the man, who is known only as Mr C.

The man's lawyer said that as no further charges were outstanding against his client that he should be discharged from the indictment.

Earlier, a nolle prosequi had been entered in relation to the unlawful carnal knowledge charge following the Supreme Court ruling.

Six men, including Mr C, were cleared of those charges in Dublin in November 2006, before being rearrested and charged with sexual assault offences.

Earlier that year, Mr C had successfully challenged the legislation relating to unlawful carnal knowledge.

The Supreme Court found that the legislation was unconstitutional because it did not allow the defence of mistaken belief of the girl's age.

This meant that the charges against the men could no longer proceed.

Liam Adams To Appeal To Supreme Court
It has emerged the brother of Sinn Fein president Gerry Adams is taking his appeal against extradition to the Republic's highest court.
