Case Against Garda 'Death Driver' Adjourned
Legal arguments today saw the adjournment of a case against a garda officer involved in an incident in which a 24-year-old man died.
Garda Damien Carey was in Dublin District Court, charged with having a bald tyre in Lucan on 4 March 2007.
The court heard that Derek O'Toole from Clondalkin was struck by the off-duty garda's car in Lucan and died from neck and head injuries.
Today at the Dublin District Court counsel for Garda Carey made an application claiming that the charges could not stand.
He told the court that the relevant section of the 1963 regulation, under which the garda was being charged, had been revoked.
He said articles 5 to 17 of the 1963 regulation had been revoked in June of 2003.
In response the prosecution solicitor applied for an adjournment to consider the matter.
He said it was a complicated legal matter which was broader than the case involving Garda Carey.
Prosecution Barrister Martin Fitzgerald said that it specifically and clearly stated that certain articles under the legislation had been revoked and he rejected the suggestion that it was a complicated legal matter.
Derek O'Toole's family was in court to observe the proceedings.
Judge Bridget Reilly adjourned the case until 31 January.

Man Fatally Stabbed In Dublin
A man has been arrested in connection with a fatal stabbing in Dublin in the early hours of this morning, 19 July. Garda responded to reports of an incident in Clinches Court, North Strand at about 4am this morning. When they arrived at the scene a man, aged in his 40s, was found with serious stab wounds.

Man Arrested In Connection With Death Of 64-Year-Old
Garda in Co Offaly have reported the arrest of a 19-year-old man in connection with the death of 64-year-old Thomas (Toddy) Dooley. The body of Mr Dooley was found at his home in Sister Senan Court, Edenderry, on 16 February. He had sustained injuries to his upper body and was pronounced dead at the scene.

Man Charged Over Murder In The Phoenix Park
A man, 27, has appeared in court charged with the murder of Gerard Donnelly in the Phoenix Park on Friday. Mr Donnelly is believed to have been burned to death and he also had a fractured skull. Ciaran Moran the accused has been remanded in custody. Meanwhile, a 17-year-old has also been arrested in connection with the murder.

Testing Firm Fined Over Fatal 2006 Crash
A company has been fined €25,000 in connection with a bus crash that killed a 15-year-old boy in 2006. Vehicle testing company O'Reilly Commercials Ltd was issued the fine after a judge found that they had failed to "ensure passengers were not exposed to safety risks.
