Canal Killing Sentence Delayed
The Court of Criminal Appeal has delayed ruling on the sentence imposed on Linda Mulhall, for her part in the killing of Farah Swaleh Noor, in order to obtain psychiatric and probation reports.
Ms Mulhall has appealed the severity of the 15-year prison sentence which was imposed by the trial judge, Mr Justice Paul Carney on the basis he should not have gone ahead with sentencing in the absence of these reports.
During the Central Criminal Court trial in October 2006, the jury heard how 38-year-old Farah Swaleh Noor's decapitated body was found in the Royal Canal 10 days after he was killed in a Ballybough flat in March 2005.
Despite extensive garda searches his head has never been found.
Ms Mulhall was found guilty of manslaughter and given a 15-year prison sentence, her sister Charlotte Mulhall was found guilty of murder and was given a life sentence.
The three Judges of the Appeal Court, Ms Justice Fidelma Macken, Mr Justice Roderick Murphy and Mr Justice Éamon de Valera said they wished to see these reports before reaching a decision on whether the 15-year sentence was too severe.
