Rogue Employers Face Stiff New Penalties

New legislation published today has outlined a clamp down on rogue employers who dodge their tax payments.

Tough new fines of up to €250,000 are to be imposed on employers that fail to declare employees to the taxman, and new powers have been granted to the National Employment Rights Authority (NERA) to prosecute and investigate rogue employers.

Their 90 inspectors can enter any workplace, with a warrant if necessary, seize data, and demand electronic passwords, as well as powers to impose on the spot fines.

Employment records must now be kept for three years, and for two years after an employee leaves.

NERA reports of investigations will be privileged from defamation, and employers will be unable to sue over allegations contained within their findings.

Other clampdowns include the working time allowed for international students. Currently, students from abroad are permitted to work only 20 hours per week, but many exceed their allotted working hours. The announcements include a crackdown on these working hours to ensure students are not coming into Ireland to work under the pretence of studying.
